This website, hereinafter referred to as "City Walk - Visit Monaco", is operated by the State of Monaco, Digital Services Department, hereinafter referred to as "the Administration", whose head office is located at 2 rue du Gabian - Immeuble Les Industries - BP 673 - MC 98000 MONACO.

Terms of Use
The purpose of these Terms of Use is to specify the conditions for using and navigating within this Website.
These Terms of Use apply to any user accessing the City Walk - Visit Monaco Website.
By using the Website, the User accepts these Terms of Use. These are applicable throughout the entire duration of use of the Website.
Each User is presumed to have accepted, without reservation, these terms when they continue their use of the website.
The User confirms having read and understood the entirety of these terms before any use of the Services offered by this Website and undertakes to comply with them.
The version of the Terms of Use currently online on the Website is the only one applicable and enforceable against the User until a new version replaces it. The Administration reserves the right to modify these Terms of Use at any time, which will come into effect upon their publication on the Website.
The User is therefore advised to regularly refer to the latest version of the Terms of Use, which is permanently available on the Website. In the event that the Terms of Use have not been accepted through the use of a contact form, then the use of this Website constitutes acceptance of the Terms of Use. In the context of sending a contact form digitally, acceptance of the Terms of Use is given by consent via a checkbox.
No tolerance regarding the application of the provisions of the Terms of Use can be interpreted as a waiver by the Administration to invoke them at a later date.
If any of the provisions herein were or became null and void under a current or future legal provision, it would be deemed unwritten without affecting the validity of the other stipulations herein.
1. Definitions
The following words and expressions beginning with a capital letter, in the singular or plural, are used herein with the following meaning:
- "Administration": the Government of Monaco / Digital Services Department
- "Terms of Use" or "ToU": these Terms of Use
- "Personal Data" / "Personal Information": any information relating to an identified or identifiable natural person ("data subject"). An "identifiable natural person" is deemed to be any natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more specific elements specific to their physical, physiological, genetic, mental, economic, cultural, or social identity.
- "Features": the features offered via the website allowing any User to access:
- "Data Controller": any natural or legal person, under private or public law, public authority, department, or any other body which determines, alone or jointly with others, the purpose and means of the processing and decides on its implementation.

- "User": designates any natural or legal person using the MonServicePublic.mc website and accessing the Services offered by this website.
2. Purpose of the Website
The purpose of these Terms of Use is to specify the conditions of access and use of the Website implemented by the Digital Services Department.
The Website allows Users to benefit from services and information concerning routes in the Principality of Monaco.
3. Access to the Website
The means of access to the Website are strictly personal and confidential.
With the exception of any connection costs, access to the Website is free of charge. Any internet connection costs are the responsibility of the User and cannot give rise to any reimbursement by the Administration.
The Administration cannot be held responsible for a malfunction of the Website and its consequences resulting from a malfunction or restricted or degraded access to the internet.
The Website is accessible freely and securely via the URL link https://citywalk.visitmonaco.com/.
4. Obligations and Responsibilities
4.1 Obligations
The User undertakes not to commit any unlawful or fraudulent act on this Website.
Any act that may contribute to tarnishing the name and/or image of the State of Monaco, or that may damage, overload, disable, discredit, or defeat the Website is prohibited by these Terms of Use.
In particular, the following is prohibited: the transmission, by email or by any other means, of content used for the purposes of persecution, harassment, defamation, discrimination, insults, or any other dissemination of information or opinion of a personal nature about one or more individuals or infringing on human rights or minor Users.
Correspondence must be courteous under all circumstances and must obey the elementary rules of politeness.
4.2 Responsibilities
The Website must not be used in an abusive or malicious manner. The Administration cannot be held liable to the User for damages of any kind, direct or indirect, resulting from the use of the Website, nor from its unavailability.
In general, the User undertakes to use the Website:
- In compliance with the laws, Monégasque regulations, the rights of third parties, as well as in compliance with intellectual property rights.
- In a fair manner and in accordance with its intended purpose.
- Under their exclusive responsibility.
The User acknowledges and accepts that the Administration cannot be held liable under the Website, in particular in the event of intrusion, alteration, or misappropriation of data or the network and any use that is unlawful or harmful to the User or a third party.
The Administration endeavors to keep the information published on this Website up to date and accurate but declines all responsibility regarding the use of erroneous or obsolete information.
The Administration does not guarantee the continuity, access, and availability of the operation of the Website and the services related thereto.
The User of the Website is required to comply with these Terms of Use and is prohibited in this context from any use or attempted use of the Website and its Features for purposes other than those provided for herein.
5. Sécurité
The Website requires a sufficiently fast internet configuration as well as equipment and material resources allowing access to and navigation on the Website. The browser must be configured to allow session "cookies".
The User is aware of the risks inherent in the use of the internet network and accepts its limitations and risks.
The Administration makes its best efforts to secure the Website with regard to the risks incurred and the nature of the data processed.
The User is prohibited from accessing or remaining, fraudulently, in all or part of the Website, deleting or modifying the data contained on the Website, fraudulently introducing data therein, altering the Website, or disrupting its proper functioning.
The User undertakes not to attempt to modify or manipulate the pages of the Website in such a way as to conceal, misappropriate, or modify them.
It is strictly prohibited: (i) to reproduce, modify, adapt, alter the Website and/or its content; (ii) to access or seek to access the source code of the Website, by resorting to decompilation techniques, reverse engineering, or any other means whatsoever; (iii) to make accessible or transmit parts of the Website or content whose access is restricted to third parties; (iv) to use the Website for an unlawful purpose; in this respect, the User undertakes not to include any false, incomplete, or inaccurate information, not to include any virus, Trojan horse, worm, time bomb, or any other program designed to damage, produce an adverse effect, intercept, or counter any system, data, or personal information.
The User must, if necessary, have a secure connection or network, an up-to-date antivirus, and an up-to-date operating system to prevent the Administration as much as possible from any damage relating to insecure use of the Website. The User undertakes to take all appropriate measures to protect their data and equipment; they are responsible for the security of their data and network, which they use at their own risk.
In the event that the User becomes aware of an event that could undermine the security of the Website, such as an error, fault, malfunction, intrusion, loss of data, vulnerability, or irregularities, they are invited to immediately contact the Administration using the contact form at the bottom of the page.
6. Intellectual Property
These Terms of Use do not imply any transfer of any kind of intellectual property rights for the benefit of the User.
6.1 Copyright
All rights attached to any content published on this Website are the exclusive property of the Administration, unless otherwise stated assigning ownership to a third party. Non-exhaustively, this includes all texts, comments, titles, names, photographs, sounds, images, data, drawings, animated sequences with or without sound, videos, features, and graphic charters, and are protected by the current legal provisions relating to the protection of copyright in Monaco.
Any form of use, representation, transformation, reproduction, adaptation, or dissemination, in whole or in part, of any element or content of this Website on any medium and by any process whatsoever is prohibited, without the express authorization of the Administration, and constitutes an offense criminally penalized by the Monégasque Courts and Tribunals.
6.2 Trademarks
The trademarks and/or logos owned by the Administration appearing on the Website are trademarks protected by the legal provisions applicable in Monaco. Any reproduction, in whole or in part, without the authorization of the Administration constitutes an offense criminally penalized by the Monégasque Courts and Tribunals.
7. Hypertext Links
The creation of hypertext links to this Website is not subject to any prior authorization from the Administration and is authorized for any medium, with the exception of those disseminating information of a polemical, pornographic, or xenophobic nature, or which may, to a greater extent, offend the sensitivity of the general public. The explicit mention of the State of Monaco in the title of the link is requested. The Administration reserves the right to request the deletion of any existing links that contravene the purpose of the Website.
The Administration's Website may contain hypertext links to external sites. The Administration does not control these sites and can in no way be held responsible, in any manner whatsoever, for the content published on these external sites.
The Administration cannot be held responsible for damages or losses that are consecutive to or in connection with the use of these external sites. Users of the Website are fully responsible and bear the risks relating to the use of these external sites. No liability can be sought from the Administration.
Any User is invited to contact the Administration in the event of a malfunction using this contact form.
8. Language
These Terms of Use may be translated into other languages for convenience purposes. However, in the event of any discrepancy, contradiction, or dispute relating to the interpretation or execution of the Terms of Use, the French version shall be authentic and shall prevail over any other version.
9. Jurisdiction
In the event of a dispute relating to the interpretation, formation, and validity of the execution of the Terms of Use and more broadly to the use of the Website, the Administration and the Users expressly acknowledge that only Monégasque legislation and regulations are applicable.
Failing an amicable settlement, any potential dispute relating to the validity, interpretation, or execution of these Terms of Use falls under the jurisdiction of the competent courts of the Principality of Monaco.
